The United States is falling behind with clarity around crypto rules — U.S. courts have been busy in the last few weeks tackling some of these questions ⚖️

And it’s clear they’re not down to just litigate crypto out of existence 🙌

Here are some of the more encouraging verdicts 🧵

1️⃣ Risley v. Uniswap Labs

An SDNY court dismissed the class action, recognizing that the devs who create protocols aren’t liable when others misuse it 💪

The logic was clear — you wouldn’t hold the people who created a self-driving car liable if someone used that car to rob a bank 🤦♂️

2️⃣ Grayscale v. the SEC

Here we saw a unanimous decision by three judges: an Obama appointee, a Trump appointee, & a Carter appointee in favor of @Grayscale 😮💨

Grayscale wanted to create a Bitcoin ETF — and the SEC refused, saying that their ETF proposal was not "designed to prevent fraudulent and manipulative acts and practices."

It was a huge win that the court so resoundingly rejected that argument.

And legal experts will tell you it’s a pretty low bar that the SEC needed to meet, and they couldn’t 👀

3️⃣ Ripple v. the SEC

In a big win for @Ripple and the crypto industry, a court rejected the SEC’s claims that all sales of their XRP token were securities.

Tldr? The SEC lost on everything argument 😏

We’ve always said that crypto was the future… but we didn’t say it would be easy.

Let’s take heart on these recent wins & keep fighting 🛡️
